land surrendered.

And, in accounting for the

price paid by the Dock Co., for the land at

Kowloon, the Colonial Government will deduct

therefrom the value of the plot of military

reserve land as agricultural land, to be deter

mined by the independent surveyor.

(a) that the War Department waives its claim

to receive free of charge certain land at

Devil's Peak, which was occupied by the War

Department for defence purposes before the lat

January 1901 → on condition that the Colonial

Government transfers to the War Department free

of charge the land (No: 5 in Schedule B.) at

West Point actually required for the Battery and

accessories, the Fire Commander's Post, and the

Submarine Mining Observing Station, down to the

road and including approaches on either side to

the two latter buildings, as shown approximately

on Plan Z.

that the Colonial Office will accelerate in

every way the valuation and settlement of the

whole question.
